Terms of Use
These Terms of Use are an agreement between you and Machitis Pty Ltd ("we", "us", "our"), based in Australia, for your use of the Eve mobile application and the website askeve.co (together, the "Services"). By creating an account or using the Services, you agree to these Terms. If you do not agree, please do not use the Services.
1. What Eve is — and what it is not
Eve provides general information about cosmetic products: an ingredient-based Safety Score and a personalised Match verdict based on the skin and hair profile you provide. Eve helps you make more informed choices about cosmetic products. It is an information tool, not a professional adviser.
2. Not medical advice — please read this section carefully
The Services do not provide medical advice, diagnosis, or treatment. Safety Scores, Match verdicts, ingredient information, and all other content in the Services are general information about cosmetic products and their ingredients. They are not intended to diagnose, treat, cure, or prevent any disease or skin/scalp/hair condition, and they are not a substitute for advice from a qualified professional.
- Everyone's skin is different — people can react differently to the same product, and a favourable score or verdict does not guarantee a product is safe or suitable for you.
- If you have a medical condition (including skin conditions or allergies), are pregnant or breastfeeding, or have any concerns about your health, consult a doctor, dermatologist, or pharmacist before making product decisions. The pregnancy-related information in Eve is general in nature and is not a substitute for medical guidance during pregnancy.
- Always perform your own patch test when trying a new product, and follow the product manufacturer's directions and warnings.
- If you experience an adverse reaction to any product, stop using it and seek medical advice. In an emergency, call 000 (Australia) or your local emergency number.
3. Accuracy of product and ingredient information
Our product and ingredient information is compiled from public sources, retailer listings, and the photos you scan. Manufacturers change formulations, and listings can be incomplete or out of date. This means:
- A score or verdict may be based on ingredient information that does not match the exact product in your hands.
- The ingredient list on the physical product packaging is always the authoritative source. Check it before purchasing or using any product, especially if you have allergies or sensitivities.
- Scores and verdicts are generated automatically by our scoring system and AI-assisted product identification, which can make mistakes (for example, misreading a label in a scanned photo).
We work to keep our data accurate, but we provide the Services on an "as-is" basis and do not guarantee the accuracy, completeness, or currency of any score, verdict, or ingredient information.
4. Eligibility and your account
You must be at least 13 years old to use the Services. If you are under 18, you confirm that a parent or guardian has reviewed and agreed to these Terms on your behalf.
You agree to provide accurate information when creating your account and profile, and to keep it up to date — your results are personalised from your profile, so inaccurate information produces less reliable results. You are responsible for keeping your login credentials secure and for activity that occurs under your account. You can delete your account at any time in the app (Profile → Delete account) or by emailing us.
5. Acceptable use
You agree not to:
- use the Services for any unlawful purpose, or in breach of these Terms;
- copy, scrape, or extract our product database, scores, or content for use in another product or service, or attempt to reverse-engineer the Services;
- interfere with or disrupt the Services, attempt to bypass usage limits or security measures, or access another person's account or data;
- upload content that infringes others' rights or contains malicious code.
We may suspend or terminate accounts that breach these Terms.
6. Subscriptions and payments
Parts of the Services are free with usage limits (for example, a weekly scan quota). Paid subscriptions unlock additional features.
- Subscriptions are purchased through your Apple ID, and all payments are processed by Apple — we never receive your payment card details.
- Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period. You can manage or cancel your subscription at any time in your Apple ID settings (Settings → your name → Subscriptions). Deleting the app does not cancel a subscription.
- If a subscription includes a free trial, the trial converts to a paid subscription unless cancelled at least 24 hours before the trial ends.
- Prices may change; Apple will notify you and, where required, seek your consent before a price change applies to you. Refunds are handled by Apple under Apple's policies.
7. Shopping links and third-party retailers
The Services may include links to third-party retailers where you can purchase products. Some of these may be affiliate links, meaning we may earn a commission if you make a purchase — at no extra cost to you. Retailers are independent businesses: we do not control their websites, prices, stock, shipping, or returns, and your purchases from them are governed by their terms and policies, not ours. A shopping link is not an endorsement beyond the score and verdict shown in the app.
8. Our content and your licence
The Services — including our scores, verdicts, scoring system, ingredient analyses, text, design, and branding — are owned by us or our licensors. We grant you a personal, non-transferable, non-commercial licence to use the Services. You retain ownership of the photos you upload; you grant us the licence needed to store and process them to provide the Services (described in our Privacy Policy).
9. Disclaimers
To the maximum extent permitted by law, the Services are provided "as is" and "as available", without warranties of any kind, express or implied. We do not warrant that the Services will be uninterrupted, error-free, or secure, or that any score, verdict, or information will be accurate or suitable for your circumstances. Sections 2 and 3 form part of this disclaimer.
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee or right you have under the Australian Consumer Law or other laws that cannot be excluded. Where our liability for breach of a non-excludable guarantee can be limited, it is limited to re-supplying the Services or paying the cost of re-supply.
10. Limitation of liability
To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, or consequential loss (including loss of data or profits) arising from your use of the Services, and our total aggregate liability for all claims relating to the Services is limited to the greater of the amounts you paid us in the 12 months before the claim and AUD $100. To the maximum extent permitted by law, we are not liable for loss arising from your use of, or reliance on, scores, verdicts, or product information, or from your use of products purchased from third-party retailers — subject always to the consumer rights preserved in section 9.
11. Changes to the Services and these Terms
We're a small team actively improving Eve: features may change, be added, or be removed at any time. We may update these Terms from time to time; if a change materially affects your rights, we'll notify you in the app or by email before it takes effect. Continuing to use the Services after a change takes effect means you accept the updated Terms.
12. Termination
You may stop using the Services and delete your account at any time. We may suspend or terminate your access if you materially breach these Terms. Sections that by their nature should survive termination (including 2, 3, 8, 9, 10, and 13) survive.
13. Governing law
These Terms are governed by the laws of New South Wales, Australia, and you and we submit to the non-exclusive jurisdiction of the courts of New South Wales. If any provision of these Terms is found unenforceable, the rest remain in effect.
